DECREE OF THE MINISTER OF INDUSTRY AND TRADE
NO. 276/MPP/KEP/6/1999
CONCERNING
REGISTRATION OF TYPES AND VARIANTS OF MOTOR VEHICLES
THE MINISTER OF INDUSTRY AND TRADE,
Considering:
- a. that in the framework of ensuring sustainable development of the automotive industry and developing the capacity to manufacture components of motor vehicles in the country, it is deemed necessary to improve the provisions on the registration of types and variants of motor vehicles;
- b. that in relation thereto, it is necessary to stipulate a decree of the Minister of Industry and Trade.
In view of :
- 1. Law No. 5/1984 on industrial affairs (Statute Book of 1984 No. 22, Supplement to Statute Book No. 3274);
- 2. Law No. 10/1995 on excise affairs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612);
- 3. Government Regulation No. 17/1986 on the authority to regulate, foster and develop industries (Statute Book of 1986 No. 23, Supplement to Statute Book No. 3330);
- 4. Government Regulation No. 13/1995 on Industrial Business Licences (Statute Book of 1995 No. 25, Supplement to Statute Book No.3596);
- 5. Presidential Decree No. 44/1974 on principles of organizations of ministries;
- 6. Presidential Decree No. 16/1987 on the simplification of procedures for the granting of industrial business licences (Statute Book of 1987 No. 22);
- 7. Presidential Decree No. 61/1998 on the status, tasks, organizational structures and working arrangements of ministries as already amended several times the latest by Presidential Decree No. 142/1998);
- 8. Presidential Decree No. 122/M/1998 on the establishment of the development reforms cabinet;
- 9. Decree of the Minister of Industry and Trade No. 444/MPP/Kep/9/98 and No. 24/MPP/Kep/1999 on organization and working arrangement of the Ministry of Industry and Trade;
DECIDES
To revoke:
Decree of the Minister of Industry and Trade No. 115/M/SK/6/1993 on the registration of types of motor vehicles.
To stipulate :
THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE REGISTRATION OF TYPES AND VARIANTS OF MOTOR VEHICLES.
Article 1
General Provisions
Referred to in this regulation as:
- 1. Motor vehicles shall be motor vehicles propelled by technical equipment (propeller engines) installed in the relevant motor vehicles.
- 2. Motor vehicles with four wheels or more shall be motor vehicles as meant in Sub Tariff Heading 8701.20, Tariff Headings HS 8702,8703,8704 and 8705.
- 3. Motor vehicles with two and three wheels shall be motor vehicles as meant Tariff Headings HS 8711 and 8703.
- 4. Types of motor vehicles shall be technical names of certain motor vehicles at least covering propellers, transmission, axles and body and/or chassis.
- 5. Variants shall be derivatives of types of motor vehicles having differences in certain components outside propellers, transmission, axles and body and/or chassis.
- 6. The registration of types of motor vehicles shall be the registration of technical specifications of types of motor vehicles of certain trade marks for manufacturing and importing.
- 7. Type registration identities shall be letters of registration issued by the Director General as evidence that the types of motor vehicles to be produced or imported have already been registered.
- 8. The Director General shall be the director general having tasks, functions and authority to foster the automotive industry.
Article 2
Obligation to register types and variants
(1) Every motor vehicle to be manufactured or imported shall have its type and variant registered.
(2) Every motor vehicle to be manufactured or imported shall be obliged to follow the numbering system of Vehicle Identification Number (VIN) in accordance with the Indonesian National Standard on identification of motor vehicles (SNI. 09.1411-1989 or its revision).
(3) Every automotive assembly manufacturer already securing the industrial business licence or automotive importer company shall be obliged to register types and variants of motor vehicles to be manufactured and imported to the Director General.
Article 3
Main characteristics of types of motor vehicles
(1) The registration of types of four- and two-wheel motor vehicles shall be the registration of technical specifications covering the following main characteristics :
- a. propellers;
- b. transmission;
- c. propeller axles;
- d. chassis and/or bodies, or frames consisting of dimension and weight.
(2) In the case of one of the main characteristics as meant in paragraph (1) being different, the motor vehicles shall be declared to have a different type.
(3) Motor vehicles changing in technical specifications, as far as they do not deal with the main characteristics as meant in paragraph (1) shall be declared to remain in the same types, but to have no different variants.
Article 4
Change in types and variants of motor vehicles
(1) The change in types or variants of motor vehicles shall be obliged to be registered to the Director General.
(2) The change in a type or variant of motor vehicles can be done in the case of the old type or variant being already produced for at least 24 (twenty four) months consecutively.
Article 5
Procedure and requirements for the registration of types and variants
(1) The registration identities of types or variants of domestic assembled or imported motor vehicles shall be issued, in the case of applications for the registration of types and variants fulfilling the procedure and requirements in force.
(2) The procedure and requirements for the requests for registration of types or variants shall be further stipulated by the Director General.
Article 6
Validity period of the registration of types and variants
(1) Registration identities of types or variants shall be valid as far as the motor vehicles are still manufactured or imported.
(2) Registration identities of types or variants of motor vehicles to be produced in the country shall be declared not valid if the motor vehicles registered are not produced in the period of 24 (twenty four) months as from the date of issuance of registration identities.
(3) Registration identities of types or variants of imported motor vehicles shall be declared not valid if the motor vehicles registered are not imported by the relevant importer companies in the period of 12 (twelve) months as from the date of issuance of registration identities.
Article 7
Conclusion
This decree shall come into force as from July 1, 1999.
For public cognizance, this decree shall be published by placing it in State Gazette of the Republic of Indonesia.
